High Court accedes to Aquino wish on ARMM appointments

THE Supreme Court on Tuesday lent credence to the wishes of President Benigno Aquino 3rd in appointing officers-in-charge (OICs) in Autonomous Region in Muslim Mindanao (ARMM).

Prior to the Court ruling, Aquino has appointed former Anak Mindanao Party list Rep. Mujiv Hataman as OIC Regional Governor after the High Court junked appeals against the postponement of ARMM polls.

The Court ruled as constitutional Republic Act (RA) No. 10153 that postpones ARMM elections and synchronizing it with the 2013 mid-term polls.

The Court en banc affirmed its earlier ruling and junked the motions for reconsideration questioning the earlier decision.

Court Administrator and spokesman Jose Midas Marquez said that with a split decision of 8 against 6, the Court favored that law deferring ARMM polls to 2013 that were originally scheduled last August 8, 2010.

The original voting was 8-7. However, Corona inhibited himself since one of the respondents to the case was the Senate and the House of Representatives and he is facing an impeachment trial.

The majority of the justices believe it is within the power of Congress to postpone the elections and within the power of Congress to authorize the President to appoint officers in charge.

However, it was clarified that the only the President can appoint the OICs.

That law gives Aquino the authority to appoint OICs, which, according to critics, was beyond the President’s constitutional power of supervision over the region.

Earlier, House Minority Leader Edcel Lagman asked the SC to declare as “unconstitutional and invalid” the law because there is no need to appoint OICs.

Citing Organic Act of ARMM or Republic Act No. 9054, Lagman said that the incumbent ARMM governor, vice governor, and Legislative Assembly members can retain their positions in holdover capacity until the May 2013 elections.
