Group chides village ID sytem

CITY OF SAN FERNANDO — Officers of the Bagong Alyansang Makabayan (Bayan) Pampanga Chapter object to the barangay identification system which the Provincial Government is planning to implement as a move against criminalities.
In a press statement, Bayan Pampanga chairman Frank Mangulabnan said provincial officials should consult constitutionalists first before enacting an ordinance compelling every citizen including visitors and transients to undergo mandatory registration at the barangay level.
“These officials should comprehend The Bill Of Rights under Article III of the 1987 Philippine Constitution,” Mangulabnan said.
He stated that Section 6 of the Bill of Rights states that the liberty of abode and of changing the same within the limits prescribed by law shall not be impaired except upon lawful order of the court. Neither shall the right to travel be impaired except in the interest of national security, public safety, or public health, as may be provided by law.
He also cited Section 2 of the bill, which reads “The right of the people to be secure in their persons, houses, papers, and effects against unreasonable searches and seizures of whatever nature and for any purpose shall be inviolable.”
Section 3. (1) The privacy of communication and correspondence shall be inviolable except upon lawful order of the court, or when public safety or order requires otherwise, as prescribed by law, he added.
With regard to the transients and visitors, Mangulabnan said that even election laws do not compel citizens to register and vote where they reside.
“Remember the tens of thousands of lahar victims of Bacolor residents residing now in a number of resettlement sites in San Fernando, Mabalacat and Magalang that cannot be compelled to register and vote in these municipalities,” he claimed.
According to him, there is no law requiring hotel/motel and even apartment tenants to register first to the nearest barangay in order to be admitted. Transient-tenants in hotels cannot even be required to divulge personal information in the registration desk, he said.
“The Constitution guarantees every citizen to reside wherever and whenever he/she wants without first securing ‘local visitor or resident visa.’ This visa can only be compelled on every citizen only in a police/military state or authoritarian regime,” Mangulabnan added.
He disclosed that the local ordinance recently enacted by the City of San Fernando’s City Council requiring its citizens to secure the so-called “Fernandino Card” in the guise of easy-pass for social services may also be questioned and repealed by the Provincial Board for its unconstitutionality.
“This is a “localized” national ID system. We should remember that same scheme of requiring every citizen to have a national ID had been attempted in numerous occasions during the previous regimes but repudiated in the House of Representatives and the Senate for being unconstitutional,” he said.
“Unless there is no enabling national law allowing this registration, local officials cannot compel the citizens in their respective constituencies to register in the barangay. Let’s have the Pampanga district representatives try this time,” Mangulabnan added.
