JI-MILF ‘financier’ loses bid to lift bank freeze order

THE Court of Appeals (CA) has turned down a motion filed by a suspected financier of the international terror group Jema’ah Islamiyah (JI) to lift the six-month freeze order issued against his bank accounts.
In a three-page resolution, CA’s Former First Division through Associate Justice Mariflor Punzalan-Castillo held that the motions for reconsideration filed by Eduard Guerra, alias Abraham Yap Alonto, and his wife Jocelyn, failed to raise new arguments that would warrant the reversal of the court’s January 19, 2012 resolution.
The assailed CA ruling denied Guerras’ motion to lift the freeze order issued on December 20, 2011, covering their bank accounts in Banco de Oro, Bank of the Philippine Islands, Land Bank of the Philippines, Maybank, Metrobank and Rizal Commercial Banking Corporation.
The bank accounts are believed to have been used to finance the terror activities of the separatist Moro Islamic Liberation Front (MILF).
Guerra, a senior member of the rebel group’s central committee, was arrested in September 2010 while trying to enter the Davao International Airport heading to Geneva, Switzerland to attend the United Nations Human Rights Council meeting. He is now facing terrorism charges.
“A perusal of both motions for reconsideration, however, reveals that the respective arguments therein are practically a mere rehash of those which the movants had already propounded in their respective motion to lift the freeze order and the motion for extension of the freeze order, and have been successfully and exhaustively disposed of by this Court in its resolution sought to be reconsidered,” the CA said.
Concurring with the ruling were Associate Justices Andres Reyes Jr. and Franchito Diamante.
The Anti-Money Laundering Council had asked the appellate court to lift the freeze order on the Guerras’ bank accounts.
Records showed Guerra, along with 62 others, was charged on June 28, 2010 before the Regional trial Court (RTC) in Sarangani in connection with their participation in the attack on the town’s police station, an electric substation and a military detachment that left two civilians dead.
On September 1, 2010, a warrant of arrest was issued in the names of Guerra and several others by the RTC in Sarangani.
In the return of the writ of warrant of arrest, Police Inspector Saguisag Mira prayed that the Intelligence and Security Group-Army be allowed to take custody of Guerra as he is considered a high-profile detainee being a major JI facilitator and financier for the MILF in purchasing and smuggling large quantities of weapons and ammunition from North Korea and other parts of East Asia.
On the same day, the lower court issued an order for the detention of Guerra at ISG-Army facilities at Fort Bonifacio.
The MILF has been demanding for his immediate release from detention, saying Guerras’ arrest was a big blow to the ongoing peace negotiations with the government.
